Intoxicating Liquorlicensed premisesbreach of Licensing Law

A breach by a licence holder of the conditions in the Licensing (Jersey) Law 1974, especially those prohibiting the supply of alcohol to under-age or intoxicated persons, may result in a fine or the suspension of the licence. Serious or repeated breaches may result in the licence being revoked.

The licensing trade must help to combat binge drinking and alcohol-fuelled violence. If a person who is clearly intoxicated is supplied with further alcohol on licensed premises and subsequently commits a serious violent offence, the Assembly will consider suspending the licence for a period of months or even revoking it where the case is particularly serious or the breach repeated.

The Licensing Unit and the Attorney General should take a pro-active stance and refer breaches of the Law to the Assembly where appropriate. Where it appears that a criminal offence has been committed by an intoxicated...
