Criminal Procedure—sentence—young offenders—multiple offences—breach of probation

A court sending a young offender to youth detention should inform him that he may be subject to a period of supervision on release, as required by the Criminal Justice (Young Offenders) (Jersey) Law 1994, art. 4.

When sentencing for a number of offences, the court should not simply announce an aggregate sentence, but should specify a separate sentence for each individual offence, even if they are to be concurrent.

In sentencing for a breach of probation, the court is sentencing for the original offence and must therefore have sufficient knowledge of the facts of that offence to assess the correct sentence. To this...
