LIMITATION of ACTIONS—STRIKING OUT—grounds for striking out
In a case in which the limitation period has clearly expired, the plaintiff's cause of action is not extinguished but the availability of the remedy should be barred: to allow him to proceed would be to waste time and money. It would therefore be improper for the defendant in such a case to apply to strike out the claim as disclosing no reasonable cause of action under the Royal Court Rules, 1982, r.6/13(a): he should do so on the grounds that it is frivolous and vexatious and an abuse of the process of the court under r.6/13(b) and (d) (Ronex Properties Ltd. v.
